Part One: Terms and Conditions
Introduction
These Terms and Conditions govern the relationship between Get Up and Grow and any person who accesses, uses or purchases any service, product or resource offered by Get Up and Grow, hereinafter referred to as the Client. By accessing any Get Up and Grow platform, purchasing any product or service, or participating in any programme, the Client agrees to be bound by these Terms and Conditions in full.
Get Up and Grow is operated by Sinta Ebersohn, a private practitioner registered and operating in terms of the laws of the Republic of South Africa.
Parties
Get Up and Grow refers to the business operated by Sinta Ebersohn, providing resilience mentorship, coaching, training and related services and resources.
The Client refers to any natural or juristic person who accesses, engages with, purchases from or participates in any offering provided by Get Up and Grow, whether free or paid.
Interpretation
In this Agreement, unless inconsistent with or otherwise indicated by the context, the following definitions apply.
The Agreement means the agreement contained in this document including all appendices, annexures and schedules hereto. Parties means all parties to this Agreement. Notice means written notice delivered via email or registered post. Services means all information, resources, events, programmes and sessions provided by Get Up and Grow, whether free or paid. Days means calendar days.
Any reference to the singular includes the plural and vice versa. Any reference to any one gender includes all genders. Clause headings have been inserted for convenience only and shall not be taken into account in interpretation. This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa.
General Terms and Conditions
By accessing and using any Get Up and Grow platform, the Client agrees to be bound by these Terms and Conditions. Should the Client not wish to be bound by this Agreement, the Client may not access, display, download, purchase, participate in or otherwise engage with any Get Up and Grow platform or offering.
Get Up and Grow reserves the right to review and amend these Terms and Conditions at any time without prior notice. Amendments become effective from the date of publication. It is the responsibility of the Client to review these Terms and Conditions periodically. Continued use of any Get Up and Grow platform or service constitutes acceptance of any amendments.
Get Up and Grow accepts no liability for any content posted to its platforms by a third party. Any content expressed by a third party on any Get Up and Grow platform does not represent the views or positions of Get Up and Grow, its operator, staff or affiliates.
Get Up and Grow does not provide legal, psychological, medical or other regulated professional advice. All content, resources and services are based on personal lived experience, extensive academic study and professional training across multiple disciplines. Clients are encouraged to seek appropriate professional support for any medical, legal or psychological concerns.
Website Use
All materials contained on the Get Up and Grow website and associated platforms are protected by applicable copyright and intellectual property law. Unauthorised reproduction, distribution or use of any materials is strictly prohibited.
All materials are provided on an as is basis. Get Up and Grow makes no warranties, express or implied, regarding the accuracy, completeness or fitness for a particular purpose of any materials published. Get Up and Grow may update, amend or remove materials at any time without notice.
Get Up and Grow is not responsible for the content of any third party websites linked from its platforms. The inclusion of any external link does not constitute an endorsement. Use of any linked website is entirely at the Client’s own risk.
In no event shall Get Up and Grow be liable for any damages or losses arising from the use of or inability to use materials on its platforms, even where Get Up and Grow has been notified of the possibility of such damage.
Services and Offerings
Get Up and Grow currently offers the following services and products. Each is subject to the specific terms set out in the relevant section below, in addition to these General Terms and Conditions.
Free Resources and Lead Magnets
Free resources, including but not limited to the 15 Minute Calm Emergency Resilience Toolkit, are provided at no cost and with no obligation to purchase any further product or service. By requesting a free resource, the Client consents to receive follow up communications from Get Up and Grow in accordance with the Communication Preferences section of this document. The Client may unsubscribe at any time.
Get Up and Grow Resilience Hub
The Get Up and Grow Resilience Hub is a free community hosted on the Skool platform. Membership is open to anyone who agrees to abide by the Community Rules of Engagement set out in this document. Membership carries no financial commitment. Get Up and Grow reserves the right to terminate membership for any Client who breaches the Community Rules of Engagement without prior notice.
The Masterclass
The Get Up and Grow Masterclass is a live, online event held on the last Thursday of every month at 12:00 SAST, with the exception of December. The session fee is USD 27 per session, payable in advance via the assigned payment options at the time of registration.
The Masterclass is a live event only. No recording, replay or substitute session is available under any circumstances, regardless of the reason for non attendance. This policy is absolute and applies without exception.
Attendance at the Masterclass is a prerequisite for registration in the 4 Week Get Up and Grow Blueprint Implementation Intensive and for application to the 1:1 Mentorship programme. This prerequisite applies to all Clients without exception, including those referred by existing Clients or mentors. Exceptions may only be made at the discretion of Get Up and Grow or Sinta Ebersohn.
Cancellation Policy: A minimum of 24 hours written notice of cancellation is required prior to the scheduled session. Cancellations received with less than 24 hours notice, and no shows on the day of the session, will forfeit their registration fee in full. No refund, credit or transfer to a future session will be granted in such circumstances. Cancellations received with more than 24 hours notice will receive a credit applicable to a future Masterclass session.
The 4 Week Get Up and Grow Blueprint Implementation Intensive
The 4 Week Get Up and Grow Blueprint Implementation Intensive is a structured, guided group programme in which Clients implement the Get Up and Grow Blueprint under the direct guidance of Sinta Ebersohn over a four week period. The programme fee is USD 397, payable in full via the assigned payment options at the time of registration.
Attendance at the Masterclass is a prerequisite for registration. No Client may register for the Intensive without having first attended a Masterclass session.
Cancellation Policy: A minimum of 24 hours written notice is required for cancellation of any individual session within the programme. The programme fee is not refundable once the programme has commenced. Where exceptional circumstances exist, Get Up and Grow or Sinta Ebersohn may, at its sole discretion, offer a credit toward a future programme.
1:1 Mentorship
The 1:1 Mentorship programme is a personal, ongoing mentorship partnership between the Client and Sinta Ebersohn. The programme is available by application only and is not open to general registration. No sales calls are conducted in connection with this programme. The monthly fee is USD 1,500 with a minimum commitment of three consecutive months, payable monthly in advance via the assigned payment options at the time of registration.
Attendance at the Masterclass is a prerequisite for all 1:1 Mentorship applicants without exception. Applications from Clients who have not attended a Masterclass session will not be considered.
Acceptance of an application is at the sole discretion of Sinta Ebersohn. Get Up and Grow reserves the right to decline any application without providing a reason.
Cancellation Policy: A minimum of 24 hours written notice is required for cancellation or rescheduling of any individual mentorship session. The monthly fee is not refundable once payment has been processed. Termination of the mentorship engagement prior to the completion of the minimum three month commitment requires 30 days written notice. Fees paid for any period within the notice period are not refundable.
Digistore24 Purchases
Some digital products offered by Get Up and Grow are sold through Digistore24, a third party digital product marketplace. Products purchased through Digistore24 on this website are processed by Digistore24 Inc., 360 Central Avenue, Suite 800, St. Petersburg, FL 33701, USA. Digistore24 processes all payments and handles all transaction data in accordance with their own privacy policy and terms of service. The withdrawal from your account will be done by Digistore24.
When you purchase a product through Digistore24, your personal and payment information is handled directly by Digistore24 and is subject to their data protection policies. Get Up and Grow does not store or have access to your payment details for Digistore24 transactions.
Payment Terms
Payments for Get Up and Grow coaching, mentorship and live event services are processed via various assigned payment options. Some digital products are sold through Digistore24 as set out in the section above. By completing any purchase, whether through PayPal, Digistore24, or any other gateway or platform, the Client confirms acceptance of that platform’s terms of service and privacy policy in addition to these Terms and Conditions. Get Up and Grow does not store or have access to the Client’s payment card details.
All fees are quoted and charged in United States Dollars (USD). The Client is responsible for any currency conversion fees or bank charges applicable to their payment.
All fees are not refundable except where explicitly stated otherwise in these Terms and Conditions or where required by applicable South African consumer protection legislation.
Intellectual Property
The Get Up and Grow Blueprint, the nine piece Resilience Puzzle, the 4 Step Get Up and Grow Process and all associated content, frameworks, methodologies, materials, scripts, documents and resources are the exclusive intellectual property of Get Up and Grow and Sinta Ebersohn. All rights are reserved.
The Client may not reproduce, distribute, adapt, publish, teach, sell or otherwise use any Get Up and Grow proprietary content, framework or methodology for any commercial or professional purpose without the prior written consent of Sinta Ebersohn. Personal use by the Client within the context of their own life and family is permitted.
Advertising, Marketing and Soliciting
No advertising, marketing or soliciting of any nature is permitted on any Get Up and Grow platform or within any Get Up and Grow community, unless by prior written agreement with Get Up and Grow. Any attempt to advertise, market or solicit within a Get Up and Grow platform will result in immediate suspension of access without notice.
Communication Preferences
By providing contact details to Get Up and Grow, whether through registration, purchase or community membership, the Client consents to receive communications from Get Up and Grow. These communications include transactional messages necessary for the delivery of services, such as confirmation emails, Zoom links, session reminders and resource delivery, as well as marketing and promotional communications including programme updates, new offerings and relevant content.
The Client may opt out of marketing communications at any time by clicking the unsubscribe link in any email or by contacting Get Up and Grow directly at info@getupandgrow.co.za. Transactional communications necessary for the delivery of a purchased service cannot be opted out of without discontinuing that service.
Community Rules of Engagement
The Get Up and Grow Resilience Hub and all associated community spaces operate under the following rules. Failure to comply will result in immediate suspension or permanent removal of membership at the sole discretion of Get Up and Grow.
Membership is open to individuals worldwide provided they agree to and abide by these rules. All members must be real persons with authentic profiles. Anonymous or false identities are not permitted.
All interactions must reflect common courtesy and mutual respect at all times. Foul language, personal attacks, harassment or disrespectful conduct of any kind will not be tolerated.
Privacy and confidentiality are paramount. Members may not share, screenshot, record or otherwise reproduce any content, discussions or personal information shared by other members, whether within the community or outside of it.
All interactions must be conducted in English to ensure inclusivity, transparency and mutual understanding. Interactions in any other language will be removed.
All contributions must be honest and truthful. Misinformation, false accusations and deliberately misleading content will not be tolerated.
Breach of Agreement
In the event that any party breaches any term of this Agreement and fails to remedy such breach within two calendar days after receipt of written notice, the other party shall be entitled, without prejudice to any other rights available in law, to cancel this Agreement with immediate effect.
Entire Agreement
This Agreement constitutes the entire agreement between the parties with regard to the matters dealt with herein. No representations, terms, conditions or warranties not contained in this Agreement shall be binding on the parties.
Indulgences
No indulgence granted by either party shall constitute a waiver of any right under this Agreement. A party shall not be precluded from exercising any right against the other by reason of having previously granted an indulgence.
Jurisdiction
This Agreement is governed by the laws of the Republic of South Africa. Get Up and Grow reserves the right at its sole discretion to institute proceedings in any competent court with jurisdiction over the matter.
Severability
Should any provision of this Agreement be found void or unenforceable for any reason, that provision shall be severed from the remainder of this Agreement, which shall remain in full force and effect.
Part Two: Privacy Policy
Introduction
Get Up and Grow is committed to protecting the privacy and personal information of all Clients and community members. This Privacy Policy sets out how personal information is collected, used, stored and protected in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA) and applicable data protection principles.
Information We Collect
Get Up and Grow collects personal information only where necessary for the delivery of its services. This includes name and contact details such as email address and phone number provided at registration or purchase, payment transaction records, participation data within community platforms, and any information voluntarily shared by the Client during coaching, mentorship or programme participation.
Get Up and Grow does not collect or store payment card details. All payment information is handled directly and securely by PayPal, Digistore24 or any other assigned payment option, as applicable, in accordance with their own privacy policies and data protection standards.
How We Use Your Information
Personal information collected by Get Up and Grow is used solely for the purposes for which it was collected. These purposes include delivery of purchased products and services, sending confirmation emails, Zoom links and session reminders, providing access to community platforms and resources, sending marketing and promotional communications where consent has been given, and improving the quality of our services.
Get Up and Grow will not sell, share or disclose personal information to third parties except where required by law or where strictly necessary for the delivery of services, such as the use of email automation platforms or community hosting platforms.
Data Retention
Personal information will be retained only for as long as is necessary to fulfil the purposes for which it was collected, or as required by applicable law. Clients may request deletion of their personal data at any time by contacting info@getupandgrow.co.za. Requests will be processed within a reasonable timeframe, subject to any legal obligations to retain certain records.
Data Security
Get Up and Grow takes reasonable and appropriate technical and organisational measures to protect personal information against loss, theft, unauthorised access, disclosure, copying, use or modification. While every reasonable precaution is taken, no data transmission or storage system can be guaranteed as completely secure. Clients provide their information at their own risk.
Third Party Platforms
Get Up and Grow uses third party platforms including VanXPro, Skool, PayPal, Digistore24, Zoom and others for the delivery of its services. Each of these platforms operates under their own privacy policies and terms of service. By using Get Up and Grow services, the Client acknowledges and accepts that data necessary for service delivery may be processed through these platforms.
Your Rights
In accordance with POPIA and applicable data protection law, Clients have the right to request access to their personal information held by Get Up and Grow, to request correction of inaccurate or incomplete information, to request deletion of their personal information subject to legal retention requirements, and to withdraw consent to marketing communications at any time.

Cookies
The Get Up and Grow website may use cookies to improve the user experience and to gather general usage analytics. Cookies do not collect personally identifiable information. Clients may configure their browser settings to decline cookies, although this may affect the functionality of certain parts of the website.
